Website Use Agreement

Introduction:

MISBAR website is an electronic platform that aims to function as an independent fact-checking platform that exists to spread accuracy and honesty among public debate, news media, and social networks and will be referred to herein as “the Site”. At MISBAR, we are committed to protecting intellectual property rights for content and all images and videos published on the Site, thus, this agreement applies when you use the Site. It allows you to manage your use of the services provided through the Site, as well as any products and services available on the Site, so that you are aware of the rules governing our relationship with you as a user of the Site

User Obligations:

By using or visiting the Site, you acknowledge and agree to the Website's Terms of Use set by MISBAR from time to time. Your access and participation on the Site or downloading materials from it, indicates your consent to comply with this agreement. MISBAR reserves the right to change the terms of this agreement by posting them on the Site, you must then indicate your acceptance and adherence to those terms to continue using the Site.

Intellectual Property Rights: 

You acknowledge and agree that the service and any necessary software used to connect to the service, as well as the (Site), contain proprietary and confidential information that is owned by the Site, and licensed, and protected by applicable intellectual property laws. You have no legal rights to any of the software used to connect with any service provided or customized for you. You also acknowledge and agree that content that includes advertisements or information provided to you through the service or by advertisers is protected by copyright, trademarks, service marks, patents, or other proprietary rights or laws. Except as permitted by the Site or advertisers, you agree not to modify, rent, sell, distribute, or create derivative works based on the service or its content, in whole or in part. You also acknowledge the exclusive rights of the Site’s trademark and logo, and the trademarks, service marks, logos, and copyrighted works contained on the Site and in the app, all of which are owned by the Site or the entity that provided this intellectual property.

Content: All rights are reserved for MISBAR website, and copying, distributing, transferring, or republishing any part of the content published on this site in any form, whether electronic or printed, is prohibited unless under the conditions outlined below and in the (Intellectual Property Rights) section.

Trademarks: All trademarks and logos that appear on this Site are the exclusive property of the Site. Their use is prohibited without prior permission.

Conditions for Using Content:

We expect all users to respect intellectual property rights, trademarks, advertising rights, and the rights of third parties on our Site, and to comply with the terms of content use. The following are the conditions for using content, which regulate the standards for using the Site's content:

• News Articles: Content from news articles may be copied or shared with a clear link to the original article (URL) (link to the article on our website).

• Opinion Articles: Copying or using any part of opinion articles published on this Site in any form, whether electronically or in print, is prohibited.

• Images and Videos: All images and videos published on this Site are the exclusive property of our Site or our content providers. Their use is prohibited without prior permission.

• Non-commercial Use: A limited portion of the content may be used for educational or non-commercial research purposes, provided the source is clearly indicated.

• Comments: We welcome readers’ comments, but we reserve the right to delete any comment that violates the law, public morals, or infringes the rights of others.

• Links: You may place links to our Site on other sites, provided it is done fairly and does not harm the reputation of our Site.

User Responsibilities:

Published Content: Users are responsible for the content (comments) they post on the Site.

Behavior: Users are prohibited from posting any content that is offensive, incites hatred, threatens others, or invades their privacy.

Our policy is to disclose personal user information and any other information when we believe, at our discretion, that such disclosure is appropriate to comply with applicable laws, especially under local laws, such as Qatar's data protection laws or applicable international laws, or to enforce any contracts or agreements we have, to protect the rights, property, and safety of our users and members; this may include responding to a government authority request or legal proceedings or for fraud protection purposes.

By accepting this agreement, you waive all your rights and agree to release the Site from any claims arising from any actions taken during or as a result of investigations, or from any actions taken due to investigations by either party: the Site or in accordance with the law and authorities.

Privacy:

• Data Collection: We collect some personal data when you use the Site, such as your IP address and email address. This data is used to improve the user experience and provide personalized services in compliance with applicable data protection laws, including Qatar's data protection laws.

• Data Protection: We are committed to protecting the privacy of our users and taking all necessary measures to safeguard their personal data.

Limitation of Liability: 

The Site, its owning company, affiliates, licensors, service providers, and content providers shall not be liable for any claims for incidental, direct, indirect, or punitive damages except as permitted by Qatari law.

Disclaimer:

Your use of the Site is at your own risk. The service on the Site is provided "as is" without any express or implied warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement of rights. 

The Site does not guarantee that:

1. The service will meet your requirements.

2. The service will not be uninterrupted, and that it is secure, or error-free at all times.

3. The results of using the service will be accurate or reliable.

4. Any software errors related to the Site will be corrected.

Modification and Termination of Service:

The Site reserves the right to modify, suspend, or permanently discontinue the service (or any part thereof) at any time, with or without notice. You agree that the Site will not be held liable to you or any third party for any modifications, suspensions, or permanent discontinuations of the service.

Legal Actions:

We reserve the right to take necessary legal action against any person or entity that violates the intellectual property rights of our Site, including seeking financial compensation.

We assert our global intellectual property rights over the content published on our Site, including exclusive rights to publication, distribution, and modification.

• Policy Violation: In the event this policy is violated, the Site reserves the right to take appropriate legal action.

• Dispute Resolution: Any dispute arising from this policy shall be governed by the applicable laws in Qatar. Qatari courts shall have exclusive jurisdiction over any disputes that may arise.

Changes:

This agreement constitutes the entire agreement between you and the Site and governs the terms and conditions of your use of the service. It supersedes all previous agreements or previous or current communications. If any part of this agreement is found unenforceable, the remaining part shall remain fully in effect. Notwithstanding the above, you may also be subject to additional terms, conditions, and publication policies (including, but not limited to, the Privacy Policy and Intellectual Property Policy).

The Site may modify this Site Use Agreement at any time. When this agreement is updated, you will be notified of the changes and asked to review the new amendments. By continuing to use this Site or app after receiving a notice of changes to the terms of service, you confirm your acceptance of these changes and amendments to the terms of service.
